1.1. These general conditions and conditions for ordering an online store (hereinafter referred to as the Conditions) are valid for all legal relations arising between all persons and the forgamer.ee marketplace owned by ITKODU OÜ, registration code 14193868, Harjumaa, Tallinn linn, Punane tn 40, 13619 when making a purchase in the forgamer.ee online store.

1.2. Reading the Terms is mandatory for you.

1.3. When settling relations, the parties to the contract are guided by the Law of Obligations Act, other laws of the Republic of Estonia and other legal acts, as well as the provisions set out in forgamer.ee.

1.4. Forgamer has the right to amend and supplement these Terms and Conditions and price lists in the interests of improving the reliability of using the Forgamer.ee online store. Changes to the Terms and Conditions and the price list are displayed on the forgamer.ee store website. Changes to the Terms and Conditions and the price list and additions come into force from the moment of publication of the corresponding change or addition on the Forgamer.ee website. If you submitted your order prior to the entry into force of the changes, the legal relationship between you and Forgamer shall be subject to the terms in force at the time you submitted your order, unless otherwise provided by law or these terms and conditions.

2.1. All prices in the online store “Forgamer.ee” are indicated in euros and include VAT.

2.2. The prices of the online store “Forgamer.ee” are valid for the period of payment specified in the invoice, in accordance with the provisions set out in clause 4.

2.3. “Forgamer” company has the right to change the prices published in the online store at any time. If the prices in the online store were changed after you submitted the order and paid for it, then Forgamer undertakes to deliver the ordered goods at the prices in force at the time of the order. You are not entitled to apply for compensation for the difference in cost. Except for system errors and site settings failure.

3.1. The goods offered by the Forgamer.ee online store can be purchased by both individuals and legal entities.

3.2. When choosing a suitable product, fill out the order form and enter the required data (last name, first name, contact phone number, e-mail address, delivery address of the goods, postal code).

3.3 The number of items in the basket can be changed. You can also change the number of copies of ordered items. To confirm the changes made, click on the “Update cart!” To continue placing an order, click on the “Next” button. You will be directed to the customer details page.

3.4. On the page with customer data, enter the required data and click on the “Continue shopping!” You will be directed to the order confirmation page and select payment methods.

3.5. When filling in the fields on the pages of the customer’s personal data and confirming the order, you should be especially careful, since the fast delivery of the goods you ordered depends on the accuracy and correctness of this information.

3.6. The sales agreement is considered concluded (the entry into force of the Agreement), starting from the receipt of the amount payable for the order to the Forgamer account after the order is confirmed.

4.1. To make a payment, select a payment method convenient for you on the checkout page.

4.2. Purchase can be paid:

4.2.1. Via Internet Banking (Swedbank; SEB; Nordea; DNB; Danske Bank; LHV)

4.2.2. On the basis of the invoice – by clicking on the order confirmation page “pay by invoice”, after that you will be sent an order confirmation with the attached invoice by e-mail. After paying for the order, you will receive a confirmation of receipt of payment by e-mail.

4.2.3. By installments, by clicking for this on the ordering page on the button “pay by installments”.

4.3. The order is canceled if the payment for the order has not been received on the “Forgamer” account within 5 days.

5.1. After the entry into force of the Agreement, in accordance with clause 3.4 of the Conditions, the goods purchased in the Forgamer.ee online store can be obtained in the following ways:

5.1.1. The courier will deliver to the address specified by you in the order; 5.1.2. The goods will be sent to the postal machine at the address you specified in the order;

5.1.3. The goods can be picked up at the Forgamer office at Harjumaa, Tallinn linn, Punane tn 40, 13619.

5.2. When choosing a delivery method using a courier, the goods will be delivered to you after the entry into force of the Agreement, in accordance with clause 3.4, by the time previously agreed upon by the contact phone number specified by you when placing an order.

5.3. Information about the delivery time of the goods can be found on our page next to each specific product. (But terms may vary, so check with agents for exact delivery times)

5.4. After the transfer of the ordered goods to the courier, he will contact you to clarify the time of delivery of the goods.

5.5. The courier will deliver the goods to the address specified by you when placing the order. It is necessary to change the specified address at the agents, but it is not always possible.

5.6. When placing an order, we kindly ask you to ensure that the contact information is correct in order to avoid delays and misunderstandings in delivery. Forgamer and the courier company are not responsible for delivery delays and other misunderstandings if they are caused by inaccuracy or incorrectness of the data you entered.

5.7. Please inform about damaged goods by e-mail info@forgamers.ee or by contacting Forgamer +372 56396766. Goods damaged during courier delivery will be replaced

5.8 The terms of delivery are valid only on the territory of the Republic of Estonia.

5.9 Delivery is carried out in 2-14 working days, depending on the warehouse.

6.1. After payment for the goods, but before delivery, you have the right to cancel your order by sending a corresponding message to the e-mail address of the online store “Forgamer.ee” info@forgamers.ee along with the order number and your current account number, or by calling the Forgamer contact phone +372 56973334.

6.2 After receiving the goods, you have 14 days to familiarize yourself with the goods. If the product does not suit you, you can return it or exchange it for another product within 14 days from the receipt of the product by sending a message of the appropriate content to the online store “forgamer.ee”. You can inform about the desire to return the goods using the appropriate form. The goods can also be returned by post to the address of Harjumaa, Tallinn linn, Punane tn 40, 13619, Tallinn, to the office of Forgamer.
You must return the item in its original condition.

6.3. In the event of damage to the returned goods, the consumer is responsible for reducing the value of the goods, provided that the goods have been used more than necessary to familiarize themselves, check their properties and performance. In order to be sure of the functionality and properties of the purchased item, the consumer must use it in the way that would be possible in a retail store.

6.4. When returning goods with signs of use, Forgamer has the right to agree to a reduction in its value, provided that the goods were used for inspection in a different way than is allowed to be done in a regular store.

The consumer should familiarize himself with the characteristics and performance of the product in the same way as it would be possible to do in a regular store before buying.

6.5. If the order is canceled in accordance with clause 6.1, or in case of refusal from the goods, in accordance with clause 6.2, you will be refunded the amount paid. The money for the returned goods will be transferred to your current account, from which the order was paid, no later than 14 days from the moment we receive the return message, provided that you have returned the goods by the same date, i.e. within 14 days, except for the cases specified in clause 6.3.

6.6. Purchased goods cannot be returned if they are made according to the personal requirements of the customer, either on special order, or on the terms of the customer.

6.7. The warranty does not cover shipping costs. (By agreement or special warranty)

7.1. Forgamer is responsible for non-conformity of the goods to the requirements, as well as for defects that appear within 2 years after the delivery of the goods to you.

7.2. Forgamer is not responsible for:

7.2.1. For the deterioration of the goods and their damage due to your fault;

7.2.2. For defects resulting from improper use;

7.2.3. For normal physical wear and tear of the product as a result of normal use.

7.3. In case of non-conformity of the goods with the requirements or the presence of defects, you have the right to demand replacement of the goods or to refuse the order and return the non-conforming goods at the expense of Forgamer.

7.4. In case of return of non-conforming goods, you will be refunded the amount paid (together with the cost of transportation) to your specified bank account no later than 14 days from the date of cancellation of the order and receipt of a message about the desire to return the goods.

7.5. In addition to the rights arising from the warranty, you have other rights under the law.

8.1. When using the services of the online store “Forgamer.ee” and making purchases (upon concluding a contract), you give clear and conscious consent to the company “Forgamer” to use your personal data.

8.2. Personal data received by Forgamer are entered into the relevant customer register and are used to present the sale and offer services.

8.3. The source of obtaining personal data is the emergence of customer relations when registering an order in the online store “Forgamer.ee”.

8.4 The registered personal data includes data concerning your order: personal code, surname, first name, street, house and apartment number, city / town, postal code, telephone number, e-mail address, year of birth, gender, delivery method , payment method used, acceptance of the Terms and Conditions, consent to receive trade offers, notes entered at the e-mail address.

8.5. All personal data of customers published during their visit to the online store “Forgamer.ee” and while making purchases are treated as confidential information. An encrypted personal data transmission channel ensures the security of personal data and bank details. Forgamer does not have access to this data.

8.6. Personal data is processed by Forgamer company ITKODU OÜ registration code 14193868, Harjumaa, Tallinn linn, Punane tn 40, 13619

8.7. The personal data of the customer, necessary for the delivery of the goods to the customer, are transferred to the company supplying the courier service.

8.8. Hereby Forgamer confirms that the protection of personal data is ensured by all security measures arising from the law.

8.9. Forgamer undertakes not to transfer registered personal data to unauthorized persons.

8.10. Forgamer reserves the right to transfer personal data concerning customers to a legally entitled person who processes personal data in order to fulfill an obligation prescribed by law, as well as to a person who has a statutory right, and this happens to protect the freedom, health and life of the customer or a third party.

8.11. You have the right to check the personal data concerning you, as well as change them, or request the deletion of data from the register.

8.12. When placing an order, you simultaneously provide ITKodu with consent to send an order confirmation to your specified e-mail address.

9.1. Forgamer is liable to you, and you are liable to Forgamer for damage caused to the other party by violation of these Terms in the cases and to the extent established by the legislation of the Republic of Estonia.

9.2. Forgamer shall not be liable for any damage suffered by you or delay in delivery of goods in the event that the damage or delay in delivery is caused by circumstances that Forgamer could not influence, and the occurrence of which Forgamer did not foresee and could not foresee ( force majeure ).

10.1 When resolving issues not specified in these Terms, they are guided by the current legal acts of the Republic of Estonia.

10.2. Disputes arising in connection with the order and purchase of goods through the online store “Forgamer.ee” between you and “Forgamer” are resolved through negotiations. In the event that no agreement has been reached, you have the right to apply to the Consumer Complaints Commission for the protection of your rights through the Consumer Protection Board, information on which you can find HERE or Harju County Court. The consumer can file a complaint on his own or through a representative. When resolving disputes, the current legislation of the Republic of Estonia is taken into account.

You can also apply to defend your rights to the EU consumer dispute resolution platform.

11.1. The product images on the  Forgamer.ee website are for illustrative purposes only.

11.2. ITKODU OÜ reserves the right to cancel the sale if any of the following problems have occurred with the product: a human error has occurred in entering the price or a technical error in the system (for example, if a laptop costing 1000 EUR is suddenly sold for 100 EUR should understand that this is a defect and the product should not be sold at that price).

In this case, ITKODU OÜ reserves the right to cancel the sale and return the money to the customer’s current account within 14 days.
